The ACLU of Massachusetts and Fick & Marx LLP have filed a class action lawsuit in federal court in Boston, which named three plaintiffs but was brought on behalf of all individuals currently incarcerated at FMC Devens. The name of the case is Grinis v. Spaulding: you can find our filings & updates in the case on the ACLU website.
We are asking the Court to order the Bureau of Prisons to release enough people that the individuals who remain are able to remain at least six feet apart at all times, including while eating, sleeping and receiving medication, and are able to follow the hygienic recommendations of the Centers for Disease Control.
We do not yet know whether the Judge will agree with us, and if he does, what process he will use to sufficiently decrease the population at FMC Devens. At the moment, we are gathering information about class members to help inform our discussions with the Court & the government.
